Terms of Use

The Terms of Use describe the rules and conditions of accessing and using the Service and procedures for the user and of the Organization for matters including Account and data management, requesting permission for use of content, privacy, support, and termination.

Definitions

For the purposes of this document:

  • Content is defined as text, imagery, articles, publications, videos, documents, audio, web pages, and any compilation of such.
  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Organization (referred to as either “the Organization”, “We”, “Us” or “Our” in this Agreement) refers to London Family Court Clinic, 254 Pall Mall St., Suite 200, London, Ontario, N6A 5P6.
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • Country refers to: Ontario, Canada
  • Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Organization. It refers to third-party companies or individuals employed by the Organization to facilitate the Service, to provide the Service on behalf of the Organization, to perform services related to the Service or to assist the Organization in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to London Family Court Clinic, accessible from https://www.lfcc.on.ca
  • You means the individual accessing or using the Service, or the organization, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acceptance of Terms

By using this Service, You are agreeing to adhering to the terms of use set within this document. You understand that the terms of this agreement may change, and you will be notified to review this agreement again when changes are instated.

Privacy

User Accounts

Users may make an Account on the Service. Users that create an account on the Service submit the information requested by the Service, including full name, email, password and optionally phone number, organization name, city, province, country. Information is stored on the Service and managed by the Service.

To request your Account and the associated data be deleted, send an email to communications@lfcc.on.ca.

Support

Support for the Service is available by email only. Send an email to communications@lfcc.on.ca.

Ownership

The London Family Court Clinic, ADR-Link, and Navigating Onward logos are owned by Us. You may not download and use them without expressed permission from Us or reproduce them for any reason.

All other images are used with permission from their original owners and must not be downloaded and used from the Service without permission from their original owners.

Content created and published by Us on non-revenue generating channels may be used by other not for profit, educational, or community-based organizations free of charge provided:

  1. The organization gives Us a written description of the intended use and/or distribution of the content.
  2. The content is not redistributed or reproduced for profit or packaged with other content that is sold for profit.
  3. Any changes, additions, or alterations to the original content are approved in advance by the leading director in consultation with the appropriate staff.
  4. Our watermarks, where they exist, are present and not altered or hidden in any way.
  5. The organization provides a signed document communicating the acceptance of these conditions—by email, direct message, or in person—to the appropriate team leader or the Executive Director.

Content as part of Our intellectual property is not permitted to be used without expressed consent from Our directors. Content as part of intellectual property is not permitted to be published in the public domain, for example on a public YouTube Channel or Facebook Group.

Any content present from an external source used in Our content—meaning not created by Us but used with permission—must only be used with expressed permission from the owner (or owners) of that content. Content may be under a Creative Commons license and must only be used within the scope of that license. We are not liable for any copyright infringement offences You commit against a third-party through use of the Service or any other means.

Termination & Modification

We reserve the right to terminate or modify your access to the Service at any time for any reason. This includes account removal, permission changes, or IP blacklisting.

The associated Account data that you’ve submitted to the Service will be removed in the event of termination.

Your Account cannot be reinstated after termination and there is no appeals process. You will not be notified if your account is terminated or modified.

Other

The Terms and Conditions of this Website shall be interpreted and governed exclusively by the laws of the province of Ontario and the laws of Canada applicable therein, without giving effect to their conflict of laws principles. You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Ontario and/or the Federal Court of Canada in Ontario, or any other judicial district or jurisdiction as London Family Court Clinic may determine in any and all actions, disputes, or controversies relating hereto.

If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

The Organization’s failure to insist upon or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right.
